TERMS & CONDITIONS

These Terms & Conditions contain two parts:

  • PART 1 – ElectriHelp Terms & Conditions (Customers)

  • PART 2 – ElectriConnect Network Partner Terms & Conditions (Contractors)

PART 1 – ELECTRIHELP TERMS & CONDITIONS (CUSTOMERS)

1) Agreement & Acceptance

By selecting the Terms & Conditions checkbox at checkout and submitting payment of the required upfront fees, the customer (“Customer”) acknowledges, understands, and agrees that these Terms & Conditions govern all services provided by ElectriHelp, a sole proprietorship operated under the trade name ElectriHelp (“ElectriHelp”), and form a legally binding agreement (“Agreement”).

Customer agrees that electronic acceptance, including timestamps, transaction records, IP address logs, and system records, constitutes valid and enforceable proof of consent.

2) Nature and Scope of Services (Remote Guidance Only / No Physical Inspection)

Customer acknowledges and agrees that ElectriHelp provides remote consultation services only, including troubleshooting guidance, planning support, and educational information based on limited information provided by the Customer (including photos, videos, written descriptions, and live video sessions).

ElectriHelp is not acting as a licensed electrical inspector, authority having jurisdiction (AHJ), engineer, or permitting authority. ElectriHelp does not certify or guarantee compliance with electrical code, safety regulations, permitting requirements, manufacturer specifications, or inspection standards.

No physical inspection, testing, measurements, voltage readings, load calculations (unless specifically discussed as part of a paid planning service), or verification of concealed conditions is performed.

All latent, concealed, inaccessible, undisclosed, or misrepresented defects, deficiencies, hazards, or non-compliant conditions are expressly excluded.

Customer is solely responsible for obtaining permits, arranging inspections, and complying with all local laws and electrical code requirements in their jurisdiction.

3) Live Guidance / Customer Work Acknowledgment

Customer acknowledges and agrees that ElectriHelp may provide live, real-time guidance and instruction via video/Zoom during consultations, including step-by-step troubleshooting and guided instruction intended to help the Customer understand the issue, identify risks, and decide next steps.

Customer understands that live guidance does not replace an on-site inspection and does not verify concealed conditions, wiring integrity, workmanship, or site safety. Customer remains solely responsible for any physical work performed and agrees to stop immediately and seek on-site licensed professional assistance if unsafe conditions exist or are suspected.

ElectriHelp strongly recommends that any physical electrical work be completed by a licensed electrician where required by law.

4) Customer Responsibility & Safety Disclaimer

Customer acknowledges that electrical work carries risk of injury, fire, shock, death, property damage, and equipment failure.

Customer agrees that they are solely responsible for any work performed on their electrical system and any decisions made based on ElectriHelp’s guidance. Customer agrees to stop work immediately and seek on-site licensed professional assistance if unsafe conditions exist or are suspected.

ElectriHelp strongly recommends that all physical electrical work be performed by a licensed electrician where required by law.

5) No Warranties

To the maximum extent permitted by applicable law, ElectriHelp disclaims all warranties, express or implied, including any implied warranties of fitness, merchantability, safety, or suitability for a particular purpose.

Customer assumes full responsibility for all actions taken based on the consultation.

6) Follow-Up Call Policy (Complimentary & Paid Calls)

Certain ElectriHelp services may include one (1) complimentary follow-up phone call of up to ten (10) minutes (“Complimentary Follow-Up Call”).

Customer acknowledges and agrees that:

  • The Complimentary Follow-Up Call must relate strictly to the original issue, project, or concern that was the reason for booking the original ElectriHelp service.

  • The Complimentary Follow-Up Call may not be used to troubleshoot new unrelated issues or new projects.

  • Complimentary follow-up calls are limited to one (1) per paid service purchase.

  • Any additional follow-up calls must be purchased separately.

  • All follow-up calls (complimentary or paid) will be completed at ElectriHelp’s next available time, unless otherwise agreed.

7) Material Delivery Eligibility

ElectriHelp may offer material delivery services as an optional convenience.

Customer acknowledges and agrees that material delivery is available only to existing ElectriHelp customers who have purchased and completed an ElectriFix Diagnosis, ElectriHelp Live Zoom Call, or ElectriHelp Project Planning Call, as ElectriHelp must review the project information before a materials list can be prepared.

ElectriHelp reserves the right to refuse material delivery requests where insufficient information is provided, where the request is outside the scope of the services, or where fulfillment is not feasible.

8) On-Site Service Credit / Reimbursement Policy (Limited Area)

ElectriHelp may offer on-site electrical services in certain limited regions.

Customer acknowledges and agrees that reimbursement or credit toward on-site electrical service is available only under the following conditions:

  • Only the ElectriHelp Live Zoom Call (30-minute consultation) is eligible for reimbursement/credit toward on-site service.

  • ElectriFix Diagnosis services are not eligible for reimbursement/credit toward on-site service.

  • ElectriHelp Project Planning Calls are not eligible for reimbursement/credit toward on-site service.

  • Reimbursement/credit is currently only available for customers located within 100 km of London, Ontario.

  • Any eligible reimbursement is applied only as a credit toward completed on-site work and is not guaranteed unless the customer proceeds with on-site service through ElectriHelp.

  • ElectriHelp reserves the right to determine, at its sole discretion, whether an on-site service is required and whether a customer is located within the eligible service area.

9) Support Outside the On-Site Credit Area

If a Customer is located outside ElectriHelp’s current on-site service credit area, reimbursement/credit toward on-site service is not available.

However, ElectriHelp may, at its sole discretion, continue providing additional advisory support, which may include reviewing third-party contractor quotes, offering general professional opinions, or assisting the Customer in identifying reputable licensed contractors in their area.

Customer acknowledges that such support is informational only. ElectriHelp does not guarantee pricing, availability, workmanship, licensing status, or performance of third-party contractors, and assumes no liability for work performed by independent electricians or contractors.

10) Future ElectriConnect Network Expansion

Customer acknowledges that ElectriHelp may expand its service model in the future through a contractor network or bidding platform currently branded as ElectriConnect.

ElectriConnect is intended to connect customers with independent licensed contractors in Canada and the United States. Customer acknowledges that independent contractors are not employees of ElectriHelp and that ElectriHelp may, in the future, facilitate job opportunities, quote comparisons, or contractor matching services through ElectriConnect.

ElectriHelp makes no guarantee that ElectriConnect services are available in all regions at this time.

ElectriHelp is not responsible for any agreements, payments, or work performed by third-party contractors.

11) Data Storage & ElectriFile Records (Customer Consent)

ElectriHelp may offer customers the option to consent to storage of their submitted information for faster future support (“ElectriFile”).

If Customer selects “yes” or otherwise consents through an ElectriHelp form or checkout process, Customer authorizes ElectriHelp to store project details, including but not limited to submitted photos, videos, panel information, consultation notes, material lists, and service summaries.

ElectriFile data is stored for operational convenience and customer service purposes only, to allow faster future consultations and repeat service requests.

Customer may request deletion of stored information at any time by contacting ElectriHelp in writing.

If Customer does not provide consent, ElectriHelp may still retain certain transaction records as required for legal, accounting, or operational purposes.

12) Limitation of Liability

To the fullest extent permitted by law, ElectriHelp’s services are provided on a limited, informational basis.

ElectriHelp shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to property damage, electrical system damage, fire, injury, loss of use, loss of revenue, or loss of profits.

Any liability arising from this Agreement shall be strictly limited to the amount paid for the specific ElectriHelp service giving rise to the claim.

Nothing in this Agreement excludes liability that cannot be excluded under applicable consumer protection legislation.

13) Right to Refuse Service / Termination of Services

ElectriHelp reserves the right, at its sole discretion, to refuse, suspend, or discontinue services where it determines that providing such services is inappropriate, unsafe, or outside the scope of its offerings.

In such cases, ElectriHelp’s sole obligation shall be to refund 95% of fees paid for the unused portion of the virtual consultation.

14) Indemnification

Customer agrees to indemnify and hold harmless ElectriHelp from third-party claims arising from Customer’s reliance on the services or work performed by others following the consultation, to the extent permitted by law.

15) ElectriFix Response Timeframes (Business Hours Policy)

ElectriFix response timeframes are calculated using business hours only, and do not apply outside of ElectriHelp’s operating hours.

For clarity, ElectriHelp business days are Monday through Saturday. Sundays and statutory holidays are not considered business days.

If an ElectriFix service is purchased outside of business hours (including evenings, overnight hours, Sundays, or statutory holidays), the response timeframe will begin on the next business day.

Example: If a customer purchases the 2-hour ElectriFix option at 9:00 PM, the response will be delivered by 11:00 AM the next business day, not by 11:00 PM the same night.

ElectriHelp reserves the right to determine business hour cut-off times based on workload, availability, and operational requirements.

16) Refund Policy

1. General Policy

ElectriHelp provides live and recorded electrical consultation services delivered digitally. Due to the nature of professional time-based services and payment processing fees, refunds are subject to the terms below.

2. Standard Refund Amount

If a refund is approved, 95% of the total purchase price will be refunded.

The remaining 5% covers non-recoverable payment processing and administrative fees.

3A. Cancellations (Live Appointments)

More than 24 hours before appointment:

Eligible for a 95% refund upon request of the service cost charged.

Less than 24 hours before appointment:

Refunds may be issued at ElectriHelp’s discretion.

If ElectriHelp missed your appointment:

We offer a full 100% refund, no questions asked in the event we miss your appointment. We will also offer 1–50% coupon on your next scheduled appointment for the inconvenience.

Customer No-Shows:

Missed appointments without notice are refundable at 50% of the amount. It is at ElectriHelp’s sole discretion to offer larger refunds with the maximum amount at 95% cost of service.

3B. Cancellations (Non-Live Appointments) – ElectriFix Recorded Service

ElectriFix is a non-live recorded response service delivered within the customer’s selected timeframe. Once we have reviewed your submitted information and begun preparing your response, the service is considered in progress and is non-refundable.

If you request cancellation immediately after purchase and before we begin reviewing your submission, we will issue a refund of 95% of the purchase price.

If We Deliver Late

If we fail to deliver your recorded response within the selected timeframe, we will automatically refund 95% of the service cost while still providing your completed ElectriFix response.

4. After Service Has Been Delivered

Once a live consultation has been completed, or a recorded response has been delivered, the service is considered rendered.

Refunds will not be issued after delivery unless:

  • A technical failure on ElectriHelp’s end prevented service delivery, or

  • An obvious billing error occurred.

5. Complimentary Follow-Up Call

Each paid consultation includes one complimentary follow-up call (up to 10 minutes) strictly related to the original issue. This follow-up does not reset or extend refund eligibility.

6. On-Site Service / Material Delivery (Local Only)

Reimbursement or credit toward on-site services is currently available only within 100 km of London, Ontario, Canada. Refund eligibility for local services may vary depending on work performed and materials purchased.

7. Processing Time

Approved refunds will be issued to the original payment method within 5–10 business days, depending on the customer’s bank or card provider.

17) Discounts, Promotions & Coupon Codes

ElectriHelp may offer promotional discounts, coupon codes, seasonal sales, or limited-time offers.

All promotions:

  • Valid only for dates/times listed

  • Must be applied at checkout

  • Cannot be applied retroactively

  • Cannot be combined unless explicitly stated

  • May be limited to specific services/products/regions

  • May be cancelled or modified without notice

ElectriHelp may refuse/cancel discounts if misuse or fraud is suspected.

One Discount Per Order: Only one discount code may be used per order unless otherwise stated.

Refunds on Discounted Purchases: Refund reflects the discounted price actually paid.

18) Military, Veteran & First Responder Discount Policy

ElectriHelp offers a 15% discount for eligible customers.

  1. Eligibility: proof required (ID may be redacted)

  2. Verification: discount codes issued after verification

  3. Non-Transferable

  4. One Discount Per Transaction: not combinable unless stated

  5. Misrepresentation may result in cancellation/refusal of future service

19) DISPUTE RESOLUTION / ARBITRATION (CANADA)

MANDATORY ARBITRATION – CANADA

All disputes arising out of or relating to this Agreement or services shall be resolved exclusively by binding arbitration and not by a court of law, except as prohibited by applicable law.

Arbitration shall be conducted under the ADR Institute of Canada (ADRIC) Arbitration Rules.

Arbitration shall take place virtually or in the Customer’s province of residence, at the Customer’s election.

ElectriHelp shall pay all arbitration filing and administrative fees beyond an amount equal to a local small-claims court filing fee.

Each party shall bear its own legal fees unless otherwise awarded by the arbitrator.

This arbitration clause shall survive termination of this Agreement.

Small Claims Carve-Out: Either party may elect to bring an individual claim in small claims court instead of arbitration, provided the claim is within jurisdiction and brought on an individual basis only. No class actions permitted.

Governing Law (Canada)

This Agreement shall be governed by the laws of the Province or Territory expressly designated by ElectriHelp at checkout, without regard to conflict-of-law principles.

PART B – UNITED STATES VERSION (APPLIES TO U.S. CUSTOMERS)

Agreement & Acceptance

By checking the Terms & Conditions box at checkout and submitting payment, Customer agrees to be bound by this Agreement. Electronic acceptance records constitute valid proof of assent.

Nature and Scope of Services (Educational Only / Remote Review Only)

Customer acknowledges that ElectriHelp is not providing licensed inspection, engineering, or code-compliance services. All guidance is educational and informational only, based on a limited virtual review of information provided by the Customer.

ElectriHelp does not guarantee safety, performance, or compliance with electrical codes, permitting requirements, or regulations.

Customer Responsibility & Safety Disclaimer

Customer acknowledges that electrical work involves risk of injury, fire, shock, death, and property damage. Customer assumes all responsibility for any actions taken based on the service and agrees to seek on-site licensed assistance where required.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELECTRIHELP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Follow-Up Call Policy

Certain services may include one (1) complimentary follow-up phone call of up to ten (10) minutes. The follow-up must relate strictly to the original issue. Additional calls require separate purchase.

Material Delivery Eligibility (U.S.)

Material delivery is not currently available in the United States.

On-Site Service Credit (U.S.)

On-site service is not currently available in the United States.

Limitation of Liability (U.S.)

ElectriHelp’s total liability shall not exceed the amount paid for the specific service. No liability for indirect, incidental, special, consequential, or punitive damages.

Indemnification (U.S.)

Customer agrees to indemnify and hold harmless ElectriHelp from third-party claims arising from Customer’s actions or reliance, except where prohibited by law.

ElectriFix Timeframes / Refund / Discounts

Timeframes, refund policy, and promotions follow the same structure stated above unless prohibited by local law.

MANDATORY ARBITRATION – UNITED STATES

All disputes shall be resolved exclusively by final and binding arbitration, not in court.

Customer waives the right to file or participate in any lawsuit, including class actions, private attorney general actions, or jury trials.

Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration may be conducted virtually or in the Customer’s state of residence, at the Customer’s choice.

ElectriHelp shall pay arbitration fees beyond the amount equivalent to a small-claims filing fee.

This arbitration provision is governed by the Federal Arbitration Act (FAA) and survives termination.

Small Claims Carve-Out: Either party may bring an individual claim in small claims court instead of arbitration if within jurisdiction and not on a class basis.

Governing Law & Venue (U.S.)

This Agreement shall be governed by the laws of the State designated by ElectriHelp at checkout, without regard to conflict-of-law rules.

Right to Refuse Service

ElectriHelp may refuse, suspend, or discontinue services where inappropriate, unsafe, or outside scope. Refund limited to unused portion.

Severability

If any provision is unenforceable, it will be enforced to the maximum extent permitted and the remainder remains in effect.

Future Business Structure Conversion

ElectriHelp may convert to an LLC, corporation, or other entity. All protections and provisions transfer automatically to the successor entity.

PART 2 – ELECTRICONNECT NETWORK PARTNER TERMS & CONDITIONS (CONTRACTORS)

ElectriConnect Contractor Network – Powered by ElectriHelp

These Terms govern participation in the ElectriConnect Network (the “Network”) operated by ElectriHelp (“we,” “us,” “our”). By applying to, enrolling in, accessing, or participating, the contractor (“Contractor,” “you,” “your”) agrees to these Terms

Participation does not create a partnership, joint venture, agency, franchise, or employment relationship.

1) Program Overview

ElectriConnect is a contractor network designed to connect licensed electrical contractors with customers who have completed ElectriHelp virtual consultations and require on-site service.

ElectriConnect may:

  • Provide job notifications

  • Share project details (photos, videos, descriptions)

  • Facilitate bidding (where applicable)

  • Facilitate introductions

ElectriConnect may operate as:

  • A bidding platform

  • A job distribution system

  • A contractor matching network

  • Or a hybrid model

ElectriHelp may modify the structure at its sole discretion and does not guarantee job volume, revenue, acceptance rates, or conversion.

2) Independent Contractor Relationship

Contractors participate as independent contractors. Nothing creates employment, agency, partnership, joint venture, or franchise.

Contractor acknowledges:

  • You are not an employee of ElectriHelp

  • You control pricing, quoting, scheduling

  • You are responsible for compliance with laws/licensing

3) Contractor Responsibilities

Contractors are solely responsible for:

  • On-site work performed

  • Safety procedures

  • Code compliance

  • Permits and inspections

  • Workmanship and warranty

  • Customer communication

  • Payment collection (unless future models change)

ElectriHelp does not supervise, direct, or control Contractor work.

4) Licensing & Insurance Requirements

Contractors must maintain:

  • Valid licensing (as required)

  • Master electrician licensing (where required)

  • Contractor licensing (where required)

  • Proof of liability insurance

ElectriHelp may verify at onboarding but does not monitor ongoing compliance. Contractors must remain compliant at all times.

5) Merit-Based Participation & Quality Standards

ElectriConnect is merit-based. ElectriHelp may evaluate:

  • Customer feedback

  • Conduct

  • Communication

  • Reliability

  • Complaints

ElectriHelp may suspend/remove contractors at its sole discretion. Decisions are final.

6) Billing, Payments & Platform Structure

ElectriConnect may operate under various structures, including:

  • Contractor-paid membership

  • Bidding-based acceptance

  • Fixed-fee access

  • Success-based fees (future model)

ElectriHelp may modify pricing/fees in the future.

Unless specified in writing:

  • Contractors set their own prices

  • Contractors collect customer payments directly

  • ElectriHelp does not guarantee payment

7) Refund Policy (Network Access)

Refund policies for membership/access plans follow what is disclosed at time of purchase.

ElectriHelp may offer:

  • Full refunds if zero job opportunities are made available in Contractor’s selected service area

  • Pro-rated refunds based on opportunities offered but declined

  • Performance-based refund reductions

Refund eligibility requires the Contractor remain active and in good standing.

ElectriHelp has sole discretion on refund determinations.

8) No Guarantee of Revenue

No guarantee of job opportunities, earnings, acceptance rates, exclusivity, or demand.

9) Limitation of Liability

ElectriHelp is not liable for:

  • Contractor workmanship

  • Customer disputes

  • Job site conditions

  • Inspection failures

  • Revenue loss

  • Third-party claims

No liability for indirect, incidental, special, consequential, or punitive damages arising from participation.

10) Customer Relationship & Liability Separation

Customers introduced through ElectriConnect are independent of ElectriHelp.

ElectriHelp does not:

  • Supervise on-site work

  • Guarantee contractor performance

  • Provide warranty on contractor services

All on-site agreements are between Contractor and Customer.

ElectriHelp is not responsible for contractor performance, payment disputes, or project outcomes. However, ElectriHelp may consider customer complaints when determining contractor status and network eligibility.

11) Termination

ElectriHelp may suspend/terminate access at any time for

  • Violations

  • Safety concerns

  • Regulatory violations

  • Reputational risk

  • Documentation failure

12) Modifications to Network

ElectriHelp may modify platform structure, fees, bidding systems, territory limits, and access levels at any time. Continued participation constitutes acceptance.

13) Arbitration & Governing Law

All disputes arising from ElectriConnect participation shall follow the same arbitration provisions outlined in Part 1 (Canada or U.S. version as applicable).
